Calculating Future Losses in Personal Injury Claims

No personal injury lawyer wants to under-settle a client’s claim. Not only is it negligent, it would also serve to deny the injured party the justice they deserve. That is why it is so important to accurately calculate the financial losses in each and every claim – both past and future.

However, calculating future losses is very different to calculating past Calculating Future Losses in Personal Injury Claimslosses. As personal injury practitioners will know, there is less tangible evidence to prove the claim. Each type of loss will be assessed according to a variety of factors, including the client’s age, gender, life expectancy, education, retirement age and earning capacity (to name just a few). This will necessitate the use of the government’s actuarial tables, known as the Ogden tables.

All of this can make the task of calculating future losses extremely overwhelming, especially for those who are new to personal injury. The fact that the law is subject to legislative changes (such as the recently introduced Civil Liberty Bill and the change to the Discount Rate) makes it all the more difficult, and can present challenges for even the most experienced lawyer.

Ogden tables and law training

Calculating future losses can, therefore, be daunting. If this is an area that you do not feel overly confident with, do not worry – we have a course designed to cover everything you need to know, from using the Ogden Tables to the new Discount Rate.
