All personal injury lawyers are wary of fraudulent claims, yet they can be extremely difficult to spot, particularly during the early stages of a claim. Fraudulent insurance claims

Fraudulent insurance claims are a common problem for claimant solicitors, particularly those who run motor accident claims. They typically fall into one of two categories –

1. The injuries are exaggerated

Sometimes a claimant lawyer will receive an enquiry from someone who has beenCan You Identity a Fraudulent Claim? involved in a motor vehicle accident for which someone else is genuinely to blame. However, the individual may exaggerate their injuries in the hope of obtaining more compensation.

This is especially prevalent in minor road traffic accidents, as the presence of soft tissue injuries (such as whiplash) cannot easily be confirmed through medical tests. Rather, such injuries are diagnosed based on the patient’s description of their symptoms, meaning they can readily be inflated.

2. It is a ‘crash for cash’ scheme

Alternatively, it may be that the accident was not genuine at all, and was in fact pre-meditated. These are known as ‘crash for cash’ schemes, and the Insurance Fraud Bureau says they cost UK insurers £336m every year.

Typically what happens is that someone will deliberately collide another vehicle (who may or may not be privy to the scheme) in the hope of getting a pay-out from their insurer. Unless there is video footage to prove otherwise, it can be very difficult to establish that the accident was staged.

Identifying fraudulent claims

The task of identifying fraudulent claims has long been a priority for insurance companies, many of which have invested large sums of money into fraud detection systems. However, claimant lawyers rarely have this luxury, so when it comes to distinguishing between the genuine claims and the fraudulent claims, they must rely on their own devices.

No claimant lawyer wants to run a fraudulent claim. It is fundamentally immoral, it brings the profession into disrepute, and of course, it is a waste of time and money. It also detracts your attention from your other clients who have legitimately been injured through no fault of their own.
