Clinical Negligence Personal Injury Training

Clinical negligence is a very niche area of personal injury law. If you run a clinical negligence caseload, or you would like to start, you will find that it is a continual learning curve. This is because clinical negligence claims are something of a hybrid – not only do you need to be a legal expert, you need a significant amount of medical knowledge too.

Some clinical negligence practitioners have previously worked in the medicalClinical Negligence Personal Injury Training profession. However, those without a medical background will quickly need to gain an understanding of a variety of illnesses and injuries. This is no mean feat, as any area of the body could potentially be affected by negligent medical care, from missed fractures to substandard abdominal surgery.

Moreover, you will need to know the subject so well as to appreciate when there has been a breach of duty and whether causation can be proven. You will also need to interpret medical expert reports, liaise with counsel and negotiate with the defendant. If you do not have the necessary knowledge, you will struggle throughout the course of the claim.

Clinical negligence requires ongoing professional development. To help you with this, we have a Clinical Negligence Update course which covers –

These are all major sources of clinical negligence claims. For each type, there are various ways in which a patient may suffer substandard medical care.

For example, a patient’s obstetric team may miss complications that arise during pregnancy or birth. This could adversely affect the health of the mother and/or child, sometimes with devastating consequences. Alternatively, perineal tears may be missed or negligently repaired, resulting in ongoing symptoms.

With regard to abdominal conditions, it might be that a patient is wrongly diagnosed. This might be an emergency, as with acute appendicitis. Or it might lead to a terminal condition, as with undetected bowel cancer. There can also be issues regarding substandard abdominal surgery, especially if any internal organs are perforated and a repair is not carried out.

Misdiagnosis is a common theme amongst orthopaedic and cardiothoracic claims, too. Delays in detecting fractures, spinal compression or heart conditions can all have an impact on the patient.
