If a Defendant admits liability, you need to know what to do next. There are various factors that must be taken into consideration. If you do not have the correct knowledge to hand, you could put yourself in aHow to Handle Admissions of Liability vulnerable position.

The first question that must be assessed is – is the admission actually an admission? There are distinct features that distinguish an offer from an admission, and you must know how to recognise these.

If it is indeed an admission, then has it been made on a Without Prejudice basis? If so, what does this mean for your client?

Admissions of liability can happen both inside and outside the Portal, and pre and post proceedings.

Again, all of these things influence the way in which the claim proceeds.

Finally, what happens if there is an application to resile from an admission? In these situations, there are certain procedural requirements to follow. Case law also has a bearing on the issue. If you have the necessary expertise, you can advise on the application’s chances of success.
