The extent of the MIB’s liability to cover injury and damage caused by uninsured motorists is in a state of constant change and uncertainty. The Road Traffic Act 1988 s.143(1) restricts the requirement for insurance to use of a motor vehicle “on a road or other public place”. The MIB is only required by their various Agreements to satisfy any judgment that would have been covered by the compulsory insurance requirements of the Road Traffic Act 1988. When somebody is injured by an uninsured motorist on private land, the MIB Agreement (in combination with the 1988 Act) does not require the MIB to satisfy any judgment obtained against the uninsured motorist.
